Antitrust Guidelines


  1. Introduction

    The WideBand Gigabit Networking Alliance (WGNA) activities are subject to Section 1 of the Sherman Act (the federal antitrust law which prohibits agreements that unreasonably restrain trade) and Section 5 of the Federal Trade Commission Act (which gives the FTC the power to prohibit various forms of unfair competition), as well as analogous state and foreign laws. Violations can subject members of the WGNA to criminal and/or civil liability.

    Potential liability can arise from activities that are undertaken with either the intent to or effect of restraining trade or injuring competitors. In addition, the fact that the participants in the WGNA may be competitors raises the opportunity for contact that would result in express or implied agreements among competitors on other areas of competition. Consequently, it is very important that the procedures of the WGNA, and the activities of its members, be subject to strict guidelines.
